Liens, PMSI’s and PPSA Security Interests – Who Receives Priority?

This session will discuss the recent decision in Tasman Logistics Services Pty Ltd v Seaco Global Australia Pty Ltd [2020] VSC 100 that held a bailee who was in possession of goods was entitled to payment in priority to the registered PPSA security interests over the goods.

This session will discuss the issue of priority payments and PPSA in light of the above case. It will also discuss instances where priority may be taken over a PMSI by the registration of a non-PMSI under section 64 of the PPSA and will cover:

  • The application of section 64 of the PPSA;
  • Interpretation of the technical requirements under section 64 of the PPSA;
  • Issuing a section 64 Notice, or the advice to provide your client if they receive a section 64 Notice.
