Contaminated Land Obligations under the New Regime – What this means for you and your client  

The Environment Protection Act 2017 (Vic) (New Act) commencing from 1 July 2021, will have a significant impact on contaminated land reporting requirements. This session will provide key insights and a review of significant and recent cases and will include:

  • How will the New Act apply and who which stakeholders will this affect;
  • Main differences between the Current Act and the New Act in relation to contamination and audits;
  • Notification and management requirements of contaminated land under the New Act;
  • New Controls and Permissions explained;
  • Transitioning ‘old permissions’ to ‘new permissions’ under the New Act;
  • Consequences of failure to notify of contaminated land under the New Act;
  • Impact on Environmental Audit System.

This session will also discuss how practitioners should be advising their clients in preparation for the commencement of the new legislation and will discuss:

  • Updating environments management systems;
  • Advising clients for the need to obtain new permissions under the New Act;
  • Assess pre-existing contamination sites and be aware of new reporting obligations;
  • The need to update contracts of sale, leases, terms and conditions to ensure compliance with the New Act’s contaminated land obligations.
