  • Reasonable and necessary support under s34 of the Act.
  • Permanence of Impairment/ Disability;
  • Importance of choice under NDIS Act.

  • Appealing the AAT’s decision to the Federal Court.

This session will discuss the implications when your client is both an NDIS participant and is entitled to personal injury compensation, and will discuss the specific provisions under the Act. This session will discuss:

  • Paybacks due to contributory negligence;
  • NDIA power to require participant to obtain compensation;
  • NDIA’s power under s105 of the Act;
  • Calculating the Compensation Reduction Amount (CRA).
