Drafting Government Policies and the Secrets to Getting it Right
When drafting new or reviewing existing Policies, the scope, consistency with the legislative instrument and style are essential to ensure they are clear. They must also ensure they do not impose unnecessary obligations on the agency or decision maker. Clarity and nuance are vital.
This session will discuss recent judicial consideration of the interface between legislation and government policy, and how this can inform the policy drafting process.
