Debt, Damages and Interest
This session will cover matters relevant to pleading debt and damages claims, the recovery of interest and the concept of a ‘debt or sum certain’ under the Supreme Court Act 1986 (Vic).
The session will discuss key principles observed in recent Court of Appeal cases and the ways in which practitioners can better control the outcome of litigation by pleading matters carefully and appropriately. Given the breadth of the concepts, the topic will be relevant to a variety of situations.
