Businesses, including travel, entertainment, and gym industries, are dealing with an influx of cancellations as a direct result of COVID-19. This session will discuss the complex issues businesses are facing and the measures they need to employ quickly to avoid or deal with a consumer complaint/ claim. This session will discuss the following:

  • Biosecurity (Human Biosecurity Emergency) (Human Coronavirus with Pandemic Potential) Declaration 2020 (Cth) and the impact on consumer law during this time;
  • Interrupted or cancelled service by the business – consumers rights;
  • Cancellation by the consumer – business owner rights;
  • Managing cancellations and delays by the business;
  • Unfair or unconscionable conduct by the business;
  • Government mandated rules – impact on businesses and refunds;
  • Consumer guarantees;
  • What now constitutes an unfair term. Does an unfair term have new meaning since COVID-19 – The ACCC’s position.
