The recent case of HDI Global Specialty SE v Wonkana No. 3 Pty Ltd [2020] NSWCA 296 highlights this rapidly evolving area.

While the insurance industry denies insurance policy payouts due to the pandemic, recent Court decisions call into question the apparent uncertainty in the interpretation of some key words in Insurance policies. It also highlights the potential for class actions against insurers.

As businesses seek to recover from months of closure many lawyers will be asked what options their clients’ have regarding recovery from insurers.
